Privacy notice

This document constitutes the privacy notice pursuant to the provisions of the Federal Law for the Protection of Personal Data Held by Individuals or Private Companies (“LFPDP” – Mexican acronym) and the provisions arising therefrom or related thereto. This privacy notice applies to personal data collected by Inmobiliaria Vrico S. de R.L de C.V. in its capacity as controller.

For the purposes of this privacy notice, any terms which are not defined herein shall be understood as having the same definition attributed to them in the Federal Law for the Protection of Personal Data Held by Individuals or Private Companies (LFPDP).

 

The object of this privacy notice is to establish the terms and conditions by which Inmobiliaria Vrico (or the representative assigned by Vrico) shall acquire and protect the owner’s personal data, in order to protect his/her privacy; use the owner’s personal data, and/or, where appropriate, transfer the owner’s personal data to third parties.

OWNER’S CONSENT

In accordance with the provisions of the LFPDP, Article 17 in particular, the owner states that:

1.-He/she has been informed of this privacy notice by the controller.

2.-He/she has read, understood and agreed to the provisions of this privacy notice, and therefore grants his/her consent regarding the processing of his/her personal data in accordance with the provisions of the LFPDP and applicable legislation.

3.- If the personal data collected contains sensitive or financial data, whether such data is supplied in a print format or by electronic means, this requires the express consent of the owner pursuant to paragraph two, Article 8 of the LFPDP and any other applicable legislation.

4.-He/she consents to Inmobiliaria Vrico and/or their representatives transferring personal data to national or foreign third parties, provided that the processing of such personal data by third parties adheres to the provisions of this privacy notice.

5.- If the owner does not oppose the terms of the privacy notice, it shall be deemed that the content herein has been agreed to and consented to and that the owner may revoke such consent at any time.

Notwithstanding any of the provisions hereof, the owner accepts that his/her consent is not required for the processing of personal data by the controller or third parties in any of the cases stipulated in Article 10 of the LFPDP.

COLLECTION OF PERSONAL DATA

Personal data may be collected via communication by telephone with the controller, their representatives or employees, acquired by the controller directly via email and/or short text messages, or through the use of their websites, by means of automatic data capture tools which enable them to collect information sent from the owner’s browser to the aforementioned websites, including the browser version used, the user’s language and the IP address of websites he/she has used to access the websites belonging to the controller or their representatives.

The following are examples of information the controller may gather, including but not limited to: names and last names; date of birth, home, work or fiscal address; personal or work email; social media username; personal or work telephone number; cell phone number; number of bank accounts held; tax ID code (RFC- Mexican acronym); population registry number (CURP – Mexican acronym).

The documentation which may be collected by Inmobiliaria Vrico in order to verify the identity of the owner of such personal data includes: voter registration card; national military service release card; professional license; passport; migratory form; federal tax registration certificate; population registry code certificate; proof of address; special credit report issued by a Credit Reporting Agency. In the case of job applicants, the following documents, among others, may also be requested: birth certificate; certificate of completion of studies; pension funds manager account statement (Afore-Mexican acronym); tax withholding certificate, as well as psychometric, medical and socio-economic studies carried out by Inmobiliaria Vrico. Personal data may also be requested regarding family members, dependents or beneficiaries, along with the appropriate documentary proof associated thereto.

PURPOSES OF PROCESSING PERSONAL DATA

The owner’s personal data is collected and processed by the controller or their representatives so that the owner is able to carry out the following activities with the controller:

  1. A) Request, purchase, exchange or return products offered by Inmobiliaria Vrico;
  2. B) Request, hire, exchange or cancel services offered by Inmobiliaria Vrico;
  3. C) Make online payments;
  4. D) Request an electronic fiscal invoice or identification document;
  5. E) Request a quote for products or services;
  6. F) Request product delivery, repair or fulfilment of warranty;
  7. G) Contact customer services;
  8. H) Take part in surveys;
  9. I) Use different services offered by corresponding websites, such as the download of content and formats;
  10. J) Share comments or suggestions regarding products and services;
  11. K) Process payments, and
  12. L) Any other activity similar to those described in the aforementioned subsections.

The controller may also use personal data, directly or through their representatives, in order to:

  1. A) Conduct studies regarding the interests and behavior of their clients, consumers, suppliers, and the third-parties with whom they deal;
  2. B) Conduct market and consumer research for the purposes of acquiring and offering personalized products and services, as well as advertising and content which best suits the needs of their clients, consumers, suppliers, and other third parties with whom they deal;
  3. C) Produce internal statistics indicating the services and products which are most valued by different segments of their clients, consumers and suppliers;
  4. D) Formalize the transactional process with their clients, consumers, suppliers, and other third parties with whom they deal;
  5. E) Manage order, evaluation and allotment procedures for suppliers and other third parties with whom they deal;
  6. F) Where necessary, verify the credit and/or payment capacity of the owner, which may be done through credit reporting agencies, in accordance with the Credit Reporting Agencies Regulation Law;
  7. G) Confirm commercial transactions performed by the owner with the controller;

The following activities shall apply to applicants for vacancies at Inmobiliaria Vrico:

  1. A) Carry out the processes of selecting and recruiting staff;
  2. B) Complete the recruitment process;

DATA COLLECTION ON BROWSING INMOBILIARIA VRICO WEBSITES AND WEB PAGES

The automatic data capture tools used by Inmobiliaria Vrico on their websites and web pages include cookies, web beacons and email links.

Links in emails from Inmobiliaria Vrico. – Emails which include links enabling Inmobiliaria Vrico to know if you have activated such link and visited the destination website: such information may be added to your profile. If you prefer Inmobiliaria Vrico not to gather information regarding your interaction with the aforementioned links, you may opt to modify the format of communications received from Inmobiliaria Vrico (for example, messages may be received in text format rather than HTML format), otherwise you may ignore the link and choose not to access its content.

TRANSFER OF DATA

Having read, understood and agreed to the terms set out this privacy notice, the owner grants his/her consent for the controller or representative to transfer personal data to national or foreign third parties, provided that the aforementioned third parties process the owner’s personal data in accordance with the provisions of this privacy notice.

LIMITATIONS ON THE USE AND DISCLOSURE OF INFORMATION

The controller and/or representatives shall keep the owner’s personal data for as long as is deemed necessary to process his/her requests for information, products and/or services, and to keep accounting, fiscal and auditing records pursuant to the LFPDP and current trading, fiscal and administrative legislation. The controller shall also control the disclosure of the aforementioned data or information regarding trading partners.

Personal data belonging to the owner which is collected by the controller and/or their representatives shall be protected using the appropriate administrative, technical and physical security measures taken against the damage, loss, alteration, destruction or unauthorized use, access or processing thereof, in accordance with the provisions of the LFPDP and the administrative regulation which may result therefrom. Notwithstanding the foregoing, Inmobiliaria Vrico cannot guarantee that unauthorized third parties will not gain access to the owner’s or controller’s physical or logical systems or to the electronic documents and files stored in their systems. Consequently, Inmobiliaria Vrico shall be no in way liable for damages which may result from such unauthorized access.

PROCEDURE FOR EXERCISING YOUR RIGHTS AS THE OWNER OF PERSONAL DATA

You may exercise your right to access, rectify and cancel your personal data at any time, oppose the processing thereof, or revoke consent granted to us for such purposes, by presenting a request which includes the following information and documentation:

1.Owner’s name, address, telephone and email address.

2.Documents which confirm your identity (plain copy of your voter registration card, professional license, passport or migratory form, in printed or digital format) or, where necessary, the identity of the owner’s legal representative (plain copy, in printed or digital format, of the power of attorney signed by the owner and representative, along with the corresponding identification).

3.A clear and accurate description of the personal data subject matter to which he/she wishes to exercise any of his/her rights.

4.Any other element or document which may facilitate the localization of the owner’s personal data.

In the case of requests to rectify personal data, the respective owner must indicate the modifications to be made and supply documentation to support such request.

The controller or their representatives will respond to the respective owner within a period of no longer than 20 business days, counting from the date on which the request is received. The aforementioned periods of time may only be extended in accordance with LFPDP.

Personal Data will be handed over free of charge, the owner will only be required to cover any justified shipping costs or costs of reproducing photocopies or other formats. If the owner reiterates his/her request within a period of less than twelve months, he/she must cover the corresponding cost equivalent to 1.5 days of the current minimum salary in the federal district in accordance with the LFPDP, unless there are fundamental modifications to the privacy notice which prompt new queries.

For the purposes of requests to cancel personal data, in addition to the provisions hereof, such requests shall also adhere to the provisions of Article 26 of the LFPDP, including the cases of exceptions to personal data cancelations stipulated therein.

A request to oppose the use of personal data by the owner thereof will grant the controller authorization to oppose the use of personal data supplied to the opposing party.

CHANGES TO THE PRIVACY NOTICE.

Inmobiliaria Vrico reserves the right to periodically update this privacy notice to reflect changes in our information practices. The owner is responsible for periodically reviewing the content of the privacy notice at VricoRealEstate.com where any changes made shall be published along with the date of the last update. The controller understands that unless otherwise specified, the owner has read, understood and agreed to the terms stipulated therein, which constitutes consent to the changes and/or updates regarding the processing of personal data
